Our office provides legal consultancy and legal representation services to domestic and foreign individuals or legal entities in the following matters related to unfair practices:
1. In cases of unfair advertising and sales methods, as well as other unlawful behaviors that violate the principle of honesty, and actions that breach or terminate contracts, misappropriation of others’ business products without authorization, unlawful disclosure of production and business secrets, non-compliance with business terms, and the use of unfair transaction terms in violation of honesty principles, if these wrongful acts are committed by those directly involved in the operation and/or by employees or workers during the performance of their duties, we offer legal assistance to employers against the wrongful competition actions.
2. In cases where wrongful competition actions have been committed through all types of press, publication, communication, and information businesses, or through future organizations that may emerge as a result of technical developments, against the owners of what has been published in the press, what has been displayed on screen, in information technology or similar media, what has been broadcasted as sound, or anything transmitted in any form, and against advertisers if they did not have the consent or were not informed about these actions or if legal action cannot be taken against them in Turkish courts, we provide legal representation. This includes actions for the preservation of the current situation, elimination of the financial consequences resulting from unfair competition, prevention of unfair competition, correction of false or misleading statements, and the pursuit of other necessary measures, as well as objections to such measures taken against clients.
3. In cases of the aforementioned wrongful acts against the individuals listed above, we assist in determining whether the act is wrongful, seeking an injunction against unfair competition, eliminating the financial consequences of unfair competition, correcting false or misleading statements if made, and preventing infringement if necessary. This may include the destruction of tools and goods that contributed to the commission of unfair competition, compensation for damages in case of fault, and the filing of a claim for moral damages if the conditions are met, or the defense of such claims brought against clients.
4. In cases of the aforementioned wrongful acts against the individuals listed above, we assist in reporting the crime to the authorities, and if a criminal case is opened against the perpetrators, we may represent clients in the criminal proceedings conducted on their behalf or file objections against such criminal complaints. If a criminal case is initiated against clients based on such criminal reports, we also provide defense services in these cases.
